These Terms are written for the current Kenya Home Services product. The operator should complete the registered-entity details and obtain Kenyan legal review before treating this document as the final legal contract.
1. What Kenya Home Services is
Kenya Home Services ("KHS", "we", "us") is a technology platform that helps customers discover and connect with independent home and business service providers. We may provide provider discovery, verification, maps, reporting, reviews, notifications, support, selected payment flows and developer integrations.
2. What we do not do
Unless a separate written agreement says otherwise, KHS does not employ or supervise providers, guarantee their work, guarantee availability, become a party to every customer-provider service contract, or guarantee that verification detects every form of fraud. A verification badge describes the applicable verification result; it is not a licence, insurance policy, employment relationship or blanket endorsement.
3. Accounts and eligibility
You must provide accurate information, protect your credentials and use only accounts you are authorized to use. KHS accounts are strictly limited to people who are 18 years of age or older. Do not impersonate another person, create fake accounts, or create new accounts to evade enforcement.
4. Customer responsibilities
Customers must describe requested work honestly, agree scope/timing/price before work begins, check qualifications or licences where relevant, respect providers, protect their property and report suspected fraud, unsafe conduct or impersonation.
5. Provider responsibilities
Providers must accurately represent their identity, services, experience, availability and qualifications; comply with applicable Kenyan laws and professional requirements; communicate honestly; respect customer property and privacy; and maintain any licences, permits, insurance or certifications required for their work.
6. Customer-provider agreements
Customers and providers are responsible for agreeing the actual service terms, including scope, price, materials, timing, cancellations, access, warranties and responsibility for damage. Mandatory consumer rights remain applicable. KHS does not ask users to waive rights that cannot legally be waived.
7. Prices and estimates
Provider prices may change and may be indicative unless expressly presented as a binding quote. Users should confirm the final scope and price before work starts. Where mandatory consumer protections apply, they continue to apply.
8. Payments
Some KHS features may use third-party payment providers. Checkout should show the charge and purpose before payment. Never disclose a payment PIN, OTP, CVV or other payment secret to another user or to KHS support. Refunds and reversals depend on the applicable transaction terms, payment provider rules and Kenyan law.
9. Reviews, reports and content
You may submit reviews, reports, photographs and profile information only where you have the right to do so. Do not submit threats, fabricated accusations, private information without lawful justification, malware, fraudulent evidence or copyrighted material you are not authorized to use. KHS may host, display, moderate and process submitted content as needed to operate and secure the Platform, subject to our Privacy Policy.
10. Prohibited conduct
- Fraud, theft, extortion or impersonation.
- Unlawful goods or services.
- Threats, stalking, harassment or exploitation.
- Fake profiles, reviews, verification documents or evidence.
- Malware, attacks, credential theft or security bypass.
- Unauthorized scraping, bulk harvesting or spam.
- Misuse of personal information or surveillance.
- Payment or verification manipulation.
- Creating accounts to evade a restriction.
11. Safety
KHS is not an emergency service. If there is immediate danger, serious injury, fire, a crime in progress or another emergency, contact the appropriate emergency or law-enforcement service first. Use KHS reporting for Platform-related safety and policy concerns.
12. Account suspension, bans and appeals
KHS may warn, remove content, restrict features, temporarily suspend, hold verification, terminate an account or revoke an API key where reasonably necessary to protect users, investigate fraud or abuse, enforce these Terms, protect security or comply with law. Immediate action may be taken when delay could create serious safety, privacy, fraud or security risk. Where practical, enforcement notices explain what happened, what action was taken and how to appeal. Appeals can be submitted through support and should include the account identifier, action received, explanation and evidence.
13. Developer API
Approved developers may use the versioned KHS API under the Developer API documentation and API terms. API keys are credentials and must remain server-side. KHS may impose scopes, rate limits, quotas, versioning and revocation. API data may not be used to harass, profile, discriminate against, stalk, spam or re-identify people.
14. Intellectual property
KHS software, branding, interfaces, original documentation and other protected materials belong to KHS or its licensors unless stated otherwise. You may not copy, resell, mirror, reverse engineer or commercially exploit protected materials except as permitted by law or written permission.
15. Third-party services
KHS may depend on hosting, identity verification, maps, communications, payment, AI, analytics and other third-party services. Those providers may have separate terms. KHS remains responsible for the disclosures made in its Privacy Policy to the extent required by law.
16. Availability and changes
Features may change, be suspended or be discontinued. Maintenance, migrations, security updates and third-party outages may affect availability. No service-level guarantee exists unless a separate written SLA says so.
17. Disclaimers and liability
To the extent permitted by law, KHS is provided on an available basis and does not guarantee that every profile is complete, every provider is suitable, or every request receives a response. Nothing here excludes statutory consumer rights or liability that cannot lawfully be excluded.
18. Privacy and data protection
Personal data is handled under the KHS Privacy Policy and applicable Kenyan data-protection law. Users may have rights concerning information, access, correction, objection, deletion where applicable, restriction and portability.
19. Complaints and disputes
Contact KHS support first where appropriate. Customer-provider disputes should normally be addressed between the parties, without limiting statutory rights, regulator complaints, alternative dispute resolution or court remedies available under Kenyan law.
20. Governing law and changes
These Terms are intended to be governed by Kenyan law, subject to mandatory rights and remedies. We may update the Terms and will update the version/effective date. Material changes will receive appropriate notice where required.
